Q: DVRO Request After Case is Dismissed w/o prejudice in CA

My brother filed a case on 2/2020 against my sister-in-law for divorce and DVRO b/c she hit him and my dad. The court then heard the case and ordered a restraining and move out order against my sister-in-law until 3/2023 to protect my brother and dad. But on 11/2020 my brother requested and the entire case was dismissed w/o prejudice because it is my brother vs. my sister-in-law. However, my dad was also protected as well and he has never gave written consent for this request. Now if I want to have a DVRO to protect my dad against my sister-in-law because her original order is not due until 3/2023. What should I do? Thanks.
