Q: I signed a divorce mediation agreement and my lawyer didn’t show me letters from my children’s therapist that showed the

Amount of trauma they had suffered at the hands of my wife, their adopted mother. After the mediation I spoke with the therapist and learned that my oldest daughter has trauma that is very close to ptsd at 15 years old. My lawyer says this isn’t something that I can now bring to the judge and contest the custody part of the agreement. I would like a second opinion because as I said he didn’t let me read the letters because according to him he had assumed I had already and I didn’t know the extent of the damage done to my 15 year old.

A: You can try to set aside the agreement. However, this is investigation that it seems like could have been done prior to reaching an agreement, so the court may not set it aside if you didn't do your due diligence in advance.

A: You should bring it to the court’s attention immediately so the judge can determine if action will be taken. If you are not working with an attorney for your divorce it would be a good idea to do so.
