Q: Is this legal? If so how should it be tackled?

My friend's mom, Erin, got into a car accident with a lady, Emily two years ago. Emily was alone. Emily is now suing Erin on the argument that Emily was not alone and there was a passenger who was injured.

A: A geographic location does not appear, but whichever state this occurred in, turn the papers over to your insurance carrier for them to handle the lawsuit. They would assign an attorney and likely investigate the matter. Good luck

A: Emily can sue for her own injury the passenger can sue both drivers. It's a she said she said unless the police responded, and noted who was present.

The short answer is anyone can ask for a case to be heard. Emily should make a copy of whatever papers she got, turn it over to her insurance as Mr. Akpinar states.

Emily should phone her company, fax them the papers and also send hard copy, certified return receipt.
