A: You can get divorced but it is not automatic. You can file for divorce in Florida if you have lived here for more than six months. Or she can file for divorce in PR if she meets their jurisdictional requirements.

A: How long you have been separated does not have any bearing on whether you can get divorced. Florida is a no fault state and your can get divorced whether you were still together or separated for 1 day. You do need to have an attorney assist you with determining where the divorce should be filed being that your wife does not live in Florida.
