Q: What are my rights?

My boyfriend asked me and my child to move into the home that he owns 5 years ago. We share all of the bills costs, but everything is in his name. We haven’t been getting along very well and 3 nights ago while I was at work, he was arrested for his 3rd DUI. According to the sheriffs website, he was released a few hours later. I only discovered this because after not being able to reach him for 24 hours, I contacted his work and his boss told me that he was in rehab. I was then contacted by his mother who said that the relationship between us was over and I needed to move out immediately. I said I would need to speak with him and she told me flat out that this would not happen and I needed to just leave. I still have not spoken with him and I really don’t have even confirmation of where he is, but I need to know my tenet rights in this situation. Thank you in advance!

A: Very, very complicated situation. You may have property rights and possibly even a right to support under a case called "Marvin v Marvin" from 1976. You are an unmarried, cohabiting person who has pooled her money with the home owner, you may have acquired an interest in his house. Suggest that you read the Marvin case to see what your rights are, and also find the 1981 Marvin case to see how, despite a slick, expensive, LA Divorce Lawyer, Michelle Marvin did not get anything because of a failure of her proof. Watch out for mom, you may need a restraining order against her- harassment. You should contact a local family law attorney to discuss your situation.
