Q: I want to file for a divorce. I live here in Tulsa, OK and my husband lives in Florida, do I file here or in Florida?

A: You can file in Oklahoma if you have lived in Oklahoma for the last six months and file in the county where you have lived the last 30 days. If the other party does not live in Oklahoma and does not agree to submit to Oklahoma jurisdiction then you could have a jurisdictional issue so meet with an attorney to sort this out and learn your options.

A: Where you can file for divorce is governed by statute in Oklahoma. Either you or your spouse must be a resident of Oklahoma for six months; otherwise, the court does not have the power to grant your divorce. If you have been a resident of the State of Oklahoma for at least six months, you can file here.

The next question would be what's called "venue". That's the county where you file. You can file where the respondent (the person who did not file the divorce) is a resident or where the petitioner (the person who filed) has been a resident for at least 30 days.
