Q: Parole ends in July and my new charges haven't been disposed. What will happen if my parole ends before new charges?

Husband currently in jail for a parole violation due to picking up new charges. His parole is to end in July 2021. He has been in jail since 11/2019 and they still have not taken him to court. They keep resetting his court and it's been over a year now. What will happen if his parole ends and his new charges have not been disposed. Will they drop from a F3 to regular charges?

A: His parole will not end in July. Filing a motion to revoke parole wipes out the parole end date. If the allegations in the motion to revoke are found to be true, your husband is subject to a return to prison for the remainder of his sentence, no matter when that occurs. Talk with his attorney.
