Naples, FL asked in Civil Rights for Florida

Q: HOA giving me a hard time. I am asking for permission for a camera and they refuse to answer me. Are there court orders?

I have received violations for cars being parked on the side of the road and not in a drive way. Cars that’s aren’t mine. I keep receiving violations for things my neighbors do and when my lease renewal was up, the HOA tried to deny me and my children to continue to live there do to “too many violations “ I’ve probably had 4 throughout the year. In the email stating my denial, they attached a bunch of violations and pictures that had nothing to do with me. I wrote an email to them pretty much explaining that those violations were false. They finally granted me a “probation” period and stated if I have one violation I have to move out. Most residents have cameras so I asked for permission just so I can be able to make sure no one is compromising me. I sent 3 emails asking them and they are refusing to give me an answer. They are usually quick to respond but now I know they are ignoring me. Is there a court order that can make them answer my questions? I just want to have a piece of mind

A: The HOA rules either allow cameras, or they don't - or say nothing at all about cameras. Get a copy of the rules and regs, as well as their by-laws. If they allow cameras, or say nothing at all about cameras, why would you ask permission? If they don't allow cameras, you legally can't have a camera, and neither can anyone else.
