Athens, OH asked in Landlord - Tenant for Ohio

Q: Does the eviction moratorium stop me from evicting when I sell the property? They are on a month to month lease

I have a buyer for my rental property. The Tenants are on a month to month lease. We have given the tenants 60 days notice but they are unable to find a new rental. They are expressing that they plan to use the moratorium and not leave. The buyer wants to close and we need to have access to the property to update it. Can I still evict?

A: You can file an eviction for termination of the monthly lease, but it is up to the court to determine if tenants are protected by the moratorium. Use the Find a Lawyer tab to retain a local real estate attorney to advise you.
