Or how can I determine if there is an easement? And that I have the right to drive on that road to access the property? I was told there is no written road maintenance agreement. Thank you!
A: An easement must be in the servient tenement's title, not yours (the dominant tenement). Hire an attorney to search the adjoining parcel's title. He may need to advise you on prescriptive easements or purchasing a right of way.
