Q: How can i help with hurrying up my daughter case in court what papers can i file for a case evaluation.

She has been in a mental health facility 2 yrs now and i know its been too long. The place is not helping her at all actually she has gotten worse since being there. With alot of different meds they have had her on. I told them shes became immune to them an they should do a wash. Meaning get them out of her system while shes in a controlled atmosphere and then after about 30 or 40 days start fresh with medication. Regaurdless her court appointed attorney has not did much of anything. But then my daughter is her worst enemy causing problems there among others an herself. Refusing to be put on a certain med that i dont agree with myself being she would need to have blood drawn weekly once on it cuz it can cause issues with blood cells. So i even said no way. But she deserves to be re evaluated. She was given some kind of test for knowing her charges understanding why she is there an passed it 100 questions an missed 2 or 3 questions. But yet the doctor says she was un compatent.

A: There is nothing you can do to move the case forward faster. You can, perhaps, help her attorney do so. Her attorney is the only person the court will accept filings from. The Forensic Center is probably not inclined to take directives from you or the attorney.

Keep in mind that under normal times, a competency evaluation and treatment takes a long time; add COVID closing courts and I'm sure affecting things at the Forensic Center....the attorney may be doing all he or she can for your daughter.

You are free to inquiry upon and interview other attorneys to see what options may be available. But honestly, you may be in better hands with a court appointed attorney as they likely have much more experience dealing with competency matters than retained attorneys might.
