Q: Our son convicted of possession of child phonograph. TDCJ put child safety zone. Court nor parole board put this on.

We have Troy's judgement that we can send and also he has his paper work from the parole board that he received before going to the program and it said nothing about child safety zone. We understand that the trial judge and the parole board are the only ones who have authority to put restrictions, not TDCJ. His case was in Brazos county.

I would love to have more information and documents to give you a comprehensive answer. However, with the info you gave you are correct when you say only the judge or board may add or change restrictions on a sentence or probation issue. I saw you said he was in a "program." I'm not sure what you mean. I would also like to know if his sentence is over or current. That always matters. If you have any dispute with a Probation or Parole Officer, ask for anything they say to be put in writing so there is a record of it, and clarity of the restrictions.

Also remember, local cities and municipalities may enact tougher anti-sex offender laws than the State has.
