San Diego, CA asked in Consumer Law for California

Q: Which class does this situation fall under? I want to make sure I am contacting the right attorneys. Thank you.

I am looking to either start a class action or personal lawsuit. There is a company that provides cosmetic surgery and I believe they are using faulty practices, faulty equipment or are just blatantly lying in order to keep a certain percentage of deposits each day and canceling peoples surgeries. In the contract it states that if your surgery is canceled that you will not receive your deposit or you have to pay a $500 rescheduling fee something along those lines.

I took a flight to Las Vegas Nevada on September 11, 2021 and return to San Diego September 18, 2021. My surgery date was scheduled for September 13, 2021. You had to be a certain BMI in order to receive the surgery and if you were over, it was stated that your surgery would be canceled. They measured me shorter than what I actually am. I have emails that expressed what my height is and to make sure that it was recorder in the chart correctly before I got there…. Not enough space to get into everything but here’s some

A: Sorry to hear that you were scammed. From your description I would consider this to be Consumer Law, however, because the procedure involves surgery, you might also want to post in Medical Malpractice; and since you are interested in bringing a class action, you could also post as Class Action. Best of luck, terrible what people will do to get "money for nothing" as the song says.
