Q: Can a mortgage broker put a mortgage under your name that isn’t yours when your a power of attorney only

I’ve never signed anything or agreed to assume the mortgage and I’ve never seen a single paper about the actual mortgage yet his mortgage company claimed it to my credit and falsely claimed the payments haven’t been made yet they all have through direct withdrawal , I’ve provided them with every document they needed including an additional power of attorney form through there company (which I wasn’t required to do legally) they have still not sent me back my original poa forms (they required the originals) they ruined my credit.

No one speaks English with this company , my dad had a massive stroke and is in a care facility. They refuse to give me info but call me non stop and when I call them back they have nothing to give me. They even sent a $7000 bill to my dads home saying I owe them to change over the mortgage but have never asked them to change it to me ever in fact I point blank told them to leave it as is until the term is up.

A: It is possible a Defamation/Libel Suit exists, but you may not have any Damages. Look hard for a lawyer that represents consumers against debt collecting. If you did not sign or assume the Note, then it is not your Debt. You may wish to get the POA revoked.
