New Brunswick, NJ asked in Landlord - Tenant for New Jersey

Q: My new lease in my NJ apartment has a $400/month rent increase. They say they can do that. What are my rights?

I moved into an apartment in New Brunswick, NJ and signed a 14 month lease. I read up on the state and believed they would increase (for this year) 4% as is the current rate (about $100 for me) but they raised us over $400 a month. When I asked they said they can charge whatever they want, given current market rate, and that I signed an addendum to my lease accepting that. The addendum simply says that "Pursuant to NJSA 2A:42-84.4 your apartment home located in New Brunswick, is exempt from rent control through March 2034." I am a New Yorker originally so rent control means something different to me. What are (if any) my rights?

A: At the conclusion of a lease term, a landlord may impose new conditions. But they must be reasonable. NJ does not recognize self help. As such, if you remain as a hold over tenant, the landlord must file an action with the court to obtain possession. Be sure to attend all scheduled hearing dates to present your side.You have a right to defend yourself and argue the $400.00 increase is not reasonable. Should the Court not decide in your favor and grant a judgment in favor of the landlord, you may ask the Court for a stay of execution of the judgment to give you a chance to find alternative housing.
