Placerville, CA asked in Consumer Law and Personal Injury for California

Q: Caught my landlord threat me with a tro&eapo 2 force evict. 4 mos wait 4 hearing, then dismissed in my favor. Help plea

Deputies serve me court orders, 4 the second time in the week, adding verbal instruction that I must immediately leave my residence, or else they would take me to jail, in their vehicle, on 8/2/2021.

On or about 6/28/21, an agent of the landlord & the landlord, tresspassed on my rental, harassed and intimidated me, issuing threats using threatening speech, I retreated to my vehicle, and called 911, who sent help. A deputy told me previously, to record any exchange between them and I, so I did so. Recorded on my camera: Repeated demands polite; firm, that they leave.. Agent's response: ridiculing & mocking me, additionally, the agent, threatns they'll get a restraining order, and get rid of me that way, two moths later, He does.

Assuming no omission on my part in any way to so much as spare me riddicule for bad behavior on my part, does this give cause to sue for Malicious Prosecution, Abuse of court Process? and What attorney does this?

A: I'm sorry this happened. What did your attorney say/do about this when they went for the restraining order AND showed this evidence you have on tape AND when they tried to evict you? Seems like THAT was the time to make sure you had your legal ducks all in a row. That said, it may be wise to hire counsel now if it is not too late. You are going to need someone who can handle criminal law AND landlord tenant law. Good luck with it...
