Selma, CA asked in Personal Injury and Criminal Law for California

Q: Hi I am a teen from fresno county and I need legal advice on my Sexual assault.

I was sexually assaulted multiple times by a family member When i was a child. When i spoke up about it my family and i decided to open up a case. This was hard because we had no actual evidence and it was so long ago. Because of a restraining order my abuser has on my parent, this made it hard for us to continue to prosecute him. Therefore my case was recently dropped. I feel so let down and frustrated. I want to know if i can speak about it and share my story online, without getting myself or my family sued. I really hope someone gets back to be with some sort of help. I don’t know what elise to do in terms of getting justice for myself.

A: If you share information of this sort publicly, the law would prevent liability if what you said was true. The problem is that there is no assurance that a jury looking at this situation would believe you or the assaulter. If the assaulter is believed, then you could be liable for defamation. So, going public has its risks.

Good luck to you.
