Q: I am an American in Germany with my wife. We started the I-130 application. Would moving out of Germany cause problems?

She is German and I was born in America. We are trying to get her a greencard but the housing and cost of living situation in Germany is hurting us. I work online and she does not work. There are many countries we could live in, within the EU, which is are more affordable to us. We are afraid that moving from Germany would delay, hinder, restart, or otherwise become problematic in our application.

A: If you identified Germany as the place where immigrant visa processing will take place, then she must process her immigrant visa in Frankfort. If everything stays the same, and the visa petition is approved, then she will have to return to Frankfort. That is, she will do the medical with a certified provider and the visa appointment in Germany. There may be other issues with consular processing. This may complicate your lives.

That is, unless you request a change in the location of processing with another form and a fee. That request will delay processing, perhaps, indefinitely. There is additional processing that must be done with the National Visa Center should the I-130 petition be approved. If you need additional help, then consider hiring a competent and experienced immigration attorney.
