New Orleans, LA asked in Family Law for Louisiana

Q: Can my son’s mother outright deny me of taking my son to another state for a few days with no court order ?

My son’s mother is basically denying my right to take my 1 month old son out to houston for a couple days to spend time with him where i reside. I infact, do have everything needed to take care of him, food, shelter, clothing.. I’ve made open communication with her multiple times letting her know if it were to happen, I’d let her know how long i would have him with me until i eventually brought him back. But when it comes to her , she won’t allow it because she’s “not ncomfortable” and doesn’t want him miles away from her where she won’t be able to see him, when i am constantly away being sent pictures and videos whenever i am not near him when we can just keep it fair and simple for the both of us and allow me to see my child as well. Can she do this knowing there is no court order between us and my name is on his birth certificate ?

A: As you can tell from your situation, it is best that you immediately contact a family or child custody lawyer to get some parameters and details in play so that you do not have this issue in the future. Good luck.
