Q: Do I have a mal practice case or should I just give up? They changed things to My medical history.was in auto accident.

I was injured on 4/18/2021 I was on light duty untill 06/22/2021. My doctor wanted me to go back to work and see if there was any pain. I had severe pain. On 07/03/2021 they gave me a X-ray to confirm nothing was broken. Then told me to try and work through it and if it still resumed we would go back to light duty. On 07/14/2021 my next appointment. My date of injury is changed to me stepping on a nail. 05/26/2021. This clinic closes down and changes ownership. When I go see my doctors they ask my how foot is from stepping on a nail. I tell them this is incorrect I was in a car accident where both vehicles were totaled. For 6 more months I never receive treatment from them for this car accident. And in a medical document they state are treating me for stepping on a nail and not a car accident. I’ve gone to my own doctors and they tell me due to the fact I had to wait so long for treatment my injuries may persist longer now. Do I have any recourse besides the medical board?

A: NOT SURE IF IT IS MED MALPRACTICE.......BUT SOUNDS LIKE THEY WERE NEGLIGENT IN THE WAY THEY KEPT RECORDS.

CONTACT A MED MAL LAWYER IN YOUR COMMUNITY AND RELAY ALL THIS INFO TO HIM/HER.

MOST LAWYERS I KNOW WILL NOT TAKE A MED MAL CASE WORTH LESS THAN $1M AND I SUSPECT THAT INCLUDES YOURS.

YOU CAN ALWAYS GO TO SMALL CLAIMS COURT AND SUE FOR UP TO $10K......BUT YOU WOULD ENCOUNTER THE SAME REQUIREMENT OF PROOF.
