Q: I was written a citation for dogs at large 44-08-408 how can they charge me with a class d felony

My dogs killed the neighbors dog supposedly. It was my understanding that dog against dog no action would be taken other than fines. Then when I get to court the judge says it's a class d felony because they caused the death of another. Does another mean an animal because I would take it as that meaning a person. The animal is property not another correct?

A: You must hire an attorney now as the Charge is serious. That Statute goes from Misdemeanors to Felonies. You need to prepare for a Preliminary Hearing immediately. It can be difficult to prove your dog was on someone else's land.
