Hazel Green, AL asked in Criminal Law for Tennessee

Q: If on a memorandum for simple possession and fail a drug test with 2 more months of probation left what will happen now?

Hi. I am on a memorandum in Lincoln County Tennessee for the crime of simple possession. They put me on 2 years of probation and fined me right at $2500. I paid my fines off about 6 months ago and only have 2 more probation visits left of my two years. I’ve held the same job down for 4 years, paid my fines early and my probation fees on time and had no run ins with the police. I missed one appointment due to work but made it up and missed another because I had Covid but also made that visit up but failed a drug test last month. Well actually the test that they gave me in office she said that I had a faint line so she sent it off to the lab then told me today that at the lab I failed the test and that the courts would be sending me a letter with a court date on it soon. What should I expect next? I’ve never been arrested before but this time that has landed me on probation and I am 47 years old and clueless to any of what I should expect. Thanks for your time.

A: Hire an attorney to represent you. Apparently you violated Probation and could serve the rest of the Sentence incarcerated. It might get extended though, so be ready to urinate cleanly at Court.
