El Dorado Hills, CA asked in Personal Injury for California

Q: I am being sued by someone who rear ended me, Should i counter sue them?-

I am being sued by someone who rear ended me and was 100% at fault per their insurance (they already paid to have my car repaired.) Should i be filing a suit against them as a tactical move to try and bring this to a close? The only thing i am suffering at this point is the 'mental anguish and distress' on having been sued by them.

A: If you has insurance at the time of the accident then your insurance company should be handling it. If not you should hire an attorney who can advise you regarding all your options.

A: Sure. If you were injured then counter-sue if you want. But you can't recover emotional damages just because they sued you. Contact your insurance company. Good luck. Patrick Steinfeld.
