Asked in Criminal Law for Texas

Q: I skipped TX to evade court for a prob. violation for x2 felony poss. charges. Can I buy out my freedom at this point?

I left TX a year ago after serving 9 months in SAFP, I failed a random color call drug test while on probation and decided I would not go to court. I don’t believe that possession of a substance should be a crime, as I am not a harm to anyone but myself and even then- I am no harm to myself. I signed a plea on 2 felony penalty group 1, under a gram charges. The plea deal was that I was to complete the SAFP program, serve 4 and 5 years concurrent on probation and complete aftercare, community service, and pay hefty fees.

The court in the county that I am convicted in was seeking to give me as much time as the amount of time given to the man who beat and subsequently killed my mother… which ultimately opened my eyes to how arbitrary and unfair the judicial system is. How can I be punished the same for having a bag of dope as another person convicted of involuntary manslaughter?

I’ve been saving money, how do I buy my way out of this mess so I can return to Texas? What are my options?

A: You can NOT "buy" your way out of your criminal charges.

The best way to spend your money is to hire a great attorney who is a zealous advocate and agressive litigator. You will need such a lawyer when you come back into the system.

The county in which you are facing charges will matter to some extent. The criminal justice system is subject to the personalities of those involved. Meaning that if the DA wants to crush you, you better get a tough attorney to defend you. The same goes for the judge and your attorney. If you get someone who is trying to help, you get the benefit of that personality, if not, you need to deal with the bad ones.

Because it is a felony, you need to face it because it will not go away. The fact that you did time, is good for you, but you need to finish things up. I can help you. If not me get a strong attorney as you will need one. Good Luck!
