San Francisco, CA asked in Family Law and Child Custody for California

Q: Is it possible for me to not require her father's signature on any document?

Never married; don't live together; his name is on birth certificate; daughter is now 10 yrs old; she lives with me; he has never been financially responsible for her; he sees her when he has time; when I need his signature on passport or any document, he refuses or makes it very difficult and becomes insulting and accusatory of me turning his daughter against him; states he misses her and wants to see her but doesn't commit to time and date; he has her phone number but rarely calls her and when he does, it's to question whether or not I'm seeing someone; when he has gone out with her, he also questions her of me and wants to go through her phone to see her pictures. He refuses to sign passport when it's time to renew it and refuses to sign car accident settlement form for us to receive the settlement.

A: You could file a paternity action. Speak with a local attorney. [I litigate cases. Anything posted here must not be construed as legal advice, nor as grounds for forming an attorney-client relationship. You should seek an attorney for formal legal advice and representation.]
