Q: What can I do if a company is not issuing your refund even though they accepted the item back?

I bought a cream from my doctor's office at Medical Providence. It was $100 and upon thinking about it I decided it was a bit too costly for me. The very next day, I went back to my doctor's office and I asked to return the cream (unopened). They were hesitant at first but in the end they took the item back and accepted the return. It's almost been two months and I have yet to receive my refund. I called them and they apologized for the delay and said they were working on it. However, it's almost been two months, and no refund. What can I do at this point? Can I take a company like Medical Providence to small claims court? Is there another way to get my money back? And can I ask for compensation? Thank you in advance.

A: You can sue in small claims court for breach of contract, promissory estoppel and also likely California Business and Professions Code § 17200 for fraudulent business practices.
