McKinney, TX asked in Divorce for Texas

Q: How can my ex sign a waiver of service from out of state?

My ex left the state the day after I filed for divorce and has agreed to sign a waiver of service so I don't have to serve them. They are potentially signing a global waiver so I can move on with the divorce without needing them. How do they go about getting it notarized and filed from another state? They are ok with no involvement in the entire divorce, is there another option than the waiver?

A: A notary public in another state, and certain authorized consular officials in another country, can notarize the document.

It doesn’t have to be a Texas notary.

If that is preprinted on the form, as is customary, the notary in the other state can just cross out Texas and write in their state.
