San Diego, CA asked in Civil Rights, Gov & Administrative Law and Small Claims for California

Q: What can I do if tow yard sold my car because the DMV incorrectly told me I could not oppose lien that was not filed.

I was unlawfully towed from private property and could not afford to pay for release and go to small claims. The DMV told me i could not oppose a lien because no lien had been filed and all i could do was a curtesy stop request that involved getting a court date and suing the DMV. I spoke to them several times as well as the lien department and investigations. I called several times because Icould not could not afford to loose my car while i was doing the steps to file the request. They assured me no lien had been filed, but it had been, and my car was sold at a lien sale. iI put all the money I had into that car. What can i do?

A: There is no easy solution to your problem.

You need to contact a lawyer who can advise you what to do.

Prepare a detailed chronology of the events as they happened. Name all the witnesses, and make copies of all the documents relating to what happened. Then take these materials to an attorney who can help you.

If you are unsure how to find a local attorney, you can go to the San Diego County Bar association's website (https://www.sdcba.org/) and click the link Find a Lawyer. They can help you.

Finally, do not delay.
