Q: should i take this to trial?
My boyfriend who lives with me had a warrant for his arrest. He was picked up by police officers and in custody. An hour later STING officers raided my home with a search warrant "for the persons of (my boyfriends name). He was already in police custody when they executed the warrant so what reason did they have to enter my home? They found drugs in my home and are charging me with possession with intent to deliver. My name is also spelled wrong on the warrant, first and last, so im wondering if i have grounds to take this to trial.
A:
You need to address the validity of that search warrant first. If you can prevail on that, then you have something. If the challenge is unsuccessful, you're free to take it to trial, but what is a jury going to think of the evidence?
No one can properly advise you on whether you should go to trial without knowing all the evidence and facts of the case, and what risks you face given your history.
