Hello, good morning. I would really appreciate it if you could give me legal or family advice? It is about my daughter, she is an American citizen but since she was two years old I brought her to Mexico because they deported me, when she was born her father asked for a DNA and it came out 99.9% that he is the father and automatically in the United States he was penalized 11 years ago that we lived Here in Mexico and her father never calls her and has never come to see her. Since 2009 she has complied with her payments until May 30, 2022. I spoke to the child support office and they told me that he now has custody of our daughter. They did not notify me that they had summoned me to court or anything I found out because I spoke to the child support offices because I was not receiving the deposits the lady told me that she would send me the documents ordered by the judge by mail the father says that I am our daughter He is in the USA and that is a lie and he accuses me of kidnapping my ow

A: There is no simple answer to your fact scenario. It sounds like there was a paternity order since you mention child support being paid. So there is a court with continuing jurisdiction over legal decisions affecting the child.

Customarily, both parents would be ordered to keep the court and each other informed as to their current residence. Customarily, the court would impose a geographic restriction on where the child can live. It’s not common that a parent be allowed to remove the child from the US for purposes of changing the child’s residence.
