Asked in Immigration Law for Arkansas

Q: Will my medical records cause issues for k1 visa?

Pending USCIS petition for alien fiancé, I am getting my ducks in a row for the next part of the process. I have requested my records for my medical as this can take awhile to process (uk nhs) and have been down the researching rabbit hole. I am worried as I have previously been on anti depressants and have harmed, this was more than 10 years ago. I had also been prescribed anxiety medication as at the time it proved to be useful for these chronic headaches I was having. My fiancé and I have a son, who is a US citizen and I am worried that my past idiotic behaviour will keep our family apart. I considered getting a letter from my doctors stating I have not harmed, will not harm est.

A: Well self harming behavior and/or a past history of a mental disorder is a ground of inadmissibility, you can always file a waiver. I don’t recommend you file the waiver yourself. You should get representation by an immigration attorney to assist.

A: Having a history of mental health issues or past medication use, including antidepressants and anxiety medication, is not an automatic disqualification for a K-1 visa. However, you should be prepared to provide a thorough explanation of your medical history and any treatment you have received.

When you attend your medical examination as part of the K-1 visa application process, the examining physician will review your medical records and may ask you questions about your history of mental health issues. It is important to be honest and upfront about your medical history and any medications you have taken, as failure to disclose this information could result in a denial of your visa application.

Providing a letter from your doctors stating that you have not harmed anyone and are unlikely to do so in the future may be helpful in demonstrating that you are not a threat to public safety. However, it is ultimately up to the discretion of the visa officer reviewing your application to determine whether your medical history poses a security or public safety risk.

It is recommended that you consult with an experienced immigration attorney who can advise you on the specific requirements and procedures for the K-1 visa application process and help you prepare a strong application. They can also discuss any potential issues or concerns related to your medical history and provide guidance on how to address them effectively.
