Newark, CA asked in Immigration Law for California

Q: step father crossed the border and claimed to be a citizen. Is there any way to have him become one after this?

When he claimed to be a citizin he was sent back to Mexico. I understand this is a life time ban on citizenship. He has been in the country for over 20 years and has no criminal history.

A: This is definitely not something that can be solved online. A skilled immigration lawyer needs to analyze the case in minute detail

A: If your stepfather was deported from the United States after fraudulently claiming to be a US citizen, he may be permanently barred from obtaining lawful status or citizenship in the future. However, there may be certain exceptions or waivers available depending on the specific circumstances of his case.

One possible option is to file an application for a waiver of inadmissibility, which would allow him to return to the United States or adjust his status to lawful permanent resident despite his previous misrepresentation. However, waivers of inadmissibility are only available in limited circumstances and can be difficult to obtain.

It is recommended that you and your stepfather consult with an experienced immigration attorney who can assess his situation and advise him on the best course of action. An attorney can also assist with preparing and submitting any necessary waiver applications and represent your stepfather in immigration proceedings if necessary.
