Q: I have endured extensive DV from my husband. I don't know what I'm entitled to under the DV laws.
There have been multiple incidents of physical, emotional, & financial abuse over the past few years. My divorce lawyer is already filing a Tevis claim. Unfortunately, husband has a knack for making the police believe it was my fault. I've been arrested 3 times and spent 2 days, 18 hours in jail.
Is there anything else I can do under the DV laws?
In the past, my soon-to-be ex-husband has dropped all legal issues against me (a previous TRO, and 2 previous simple assault charges.) The assault charges were expunged. I assume a judge wouldn't think him so concerned with his safety by his actions and the fact that we lived with each other after and during these issues? Could a judge think he was merely being malicious?
I'm considering filing further charges for incidents where I was not found at fault. I've been told the statute of limitations is a year.
