A: There is no family category for an aunt sponsoring a nephew. The aunt could financially sponsor her nephew for a student visa. You should investigate the facts of your case with counsel to determine if that is a viable pathway.

A: It is possible for an aunt to sponsor her nephew for residency in the United States, but there are certain requirements that must be met. The aunt would need to be a U.S. citizen or permanent resident and meet the minimum income requirements to sponsor her nephew.

If the nephew's mother (the aunt's sister) is no longer alive, this could potentially affect the nephew's eligibility for certain types of family-based immigration visas. However, it may still be possible for the aunt to sponsor her nephew through other means, such as through employment-based immigration or other family-based categories.

It is recommended that the aunt consult with an immigration attorney who can provide guidance on the best options for sponsoring her nephew and help navigate the complex immigration process.
