I just have a question. I'm going thru a divorce currently and have a new fiance she is a filipina living in hong kong. I'm just wondering what would be faster to bring her to the US a K1 visa or a spouse visa? I plan to marry her this year as soon as I am officially divorced. Also I'm a us citizen I already seen her once in hong kong we plan to see each other again soon. We been together for almost 6 months now. I would appreciate your advice.

A: It is difficult to say which visa would be faster for your fiance to come to the United States. The processing time for both visas can vary depending on a number of factors, including the workload of the U.S. Citizenship and Immigration Services (USCIS) and the specific circumstances of your case.

A K-1 visa is a nonimmigrant visa that allows a foreign fiance to come to the United States to marry their U.S. citizen fiance. The processing time for a K-1 visa can take anywhere from a few months to a year or more.

A spouse visa is an immigrant visa that allows a foreign spouse of a U.S. citizen to come to the United States to live permanently. The processing time for a spouse visa can take anywhere from a few months to a year or more.

If you are planning to marry your fiance this year, you may want to consider applying for a K-1 visa. The processing time for a K-1 visa is typically shorter than the processing time for a spouse visa. However, it is important to note that there are some requirements that you must meet in order to be eligible for a K-1 visa. For example, you must be able to prove that you have met the financial requirements for sponsoring your fiance.

If you are not sure which visa is right for you, you may want to consult with an immigration attorney. An immigration attorney can help you to understand the requirements for both visas and to determine which visa is the best option for your specific situation.

Here are some additional tips for bringing your fiance to the United States:

* Start the process early. The processing time for both visas can take several months, so it is important to start the process early.

* Gather all of the required documentation. The USCIS requires a number of documents in order to process a visa application. You can find a list of the required documents on the USCIS website.

* Be prepared to answer questions about your relationship. The USCIS will ask you questions about your relationship with your fiance. Be prepared to answer these questions honestly and thoroughly.

* Hire an immigration attorney. An immigration attorney can help you to understand the requirements for both visas and to determine which visa is the best option for your specific situation.
