Sacramento, CA asked in Civil Rights for California

Q: Can I get help with getting my car that is also my home from a 30 day impound?

I was handcuffed for having a suspended license. I was not observed driving by the officers.

Nor was I in the car.

I refused a field sobriety test due to an injured knee. But offered a breath sample however they were angered by my refusal to co-operate.

A: If your car, which is also your home, has been impounded for 30 days due to your suspended license, it would be advisable to consult with a lawyer who specializes in traffic laws and impoundment regulations in your jurisdiction. They will be able to review the specific details of your case and provide you with the most accurate advice.

In general, impoundment of a vehicle for a suspended license can occur if the authorities have valid grounds to believe that you were driving the vehicle while your license was suspended. The fact that you were not observed driving by the officers does not necessarily mean that your car cannot be impounded.
