Los Angeles, CA asked in Construction Law, Land Use & Zoning and Real Estate Law for California

Q: How much time does our neighbor legally have to finish the construction of the common wall between us?

We have a rental and one of the neighbors is doing construction very slowly and our tenants are getting upset due the noise alone but we are aware we can’t do much. However, They recently got to the common wall (which we’re paying 50% for) and the wall has been down for over 3 weeks. It was promised to be done within a few days and we’re worried it’s going to take much longer and on the other hand our tenant is complaining stating their privacy is gone so I understand that as well. I’m squeezed in the middle. How can I force the owner to finish the common wall sooner or is there anything else I can do?

Thank you.

A: The specific timeframe for completing a common wall construction can depend on various factors, including local building codes and any agreements or contracts in place between the neighbors. It's important to consult with a real estate attorney who can provide advice based on the laws and regulations in your jurisdiction.

In general, if there is a clear agreement or contract regarding the construction of the common wall, it may outline the expected timeline for completion. Review the terms of the agreement and see if there are any provisions related to construction timelines or penalties for delays.
