Q: Will I be able to get a motion for continuance for a hearing scheduled for 3pm tomorrow?
My ex wife and her attorney filed a motion for contempt for missing child support payments from when I was out of work. The hearing is at 3pm tomorrow. The last hour, I have been vomiting and having bad diarrhea. I am considering going to the VA hospital because it is that bad. Would I be able to get a continuance if I call up there tomorrow morning as soon as the courthouse opens? Or will I basically just be considered a no show for the hearing? I am self represented and not sure what the correct steps are to avoid further issues.
A: Yes you can file the motion; however, the court will have to rule on the motion at or before the hearing. In addition to filing the motion you should contact the judicial assistant and share that the motion was filed. Good luck!
