Memphis, TN asked in Consumer Law for California

Q: Hello! I have a double payment and was never returned the over payment.

Hello, my electric bill was over paid, double payment. 1 payment was made by me, credit card payment, the other was a check sent in. The company is saying that they "returned the money to me" but I never received. I have called them multiple times and had to have people call me back, but I never received the overpayment. They had me email someone and I never heard back. The overpayment was $500, and the check was not from me but for my account.

I am the account holder and believe the money should have gone back to me, or even a credit. Am I incorrect? I live in California (if that makes a difference)

They said they returned the money to me, and I have no record. They had me email someone, but I have not heard back, it's been months... Their wait times on the phone are 60 min every time I call back

A: Look at your credit card statements for the last 6 months. They probably reversed the cc payment. If not, maybe they mailed a check to the party who wrote the check. Ask that person. Maybe you have already done these things, but you don't say if you did.

A: In California, you're entitled to a refund or a credit for overpayment on your utility bill. You should document all your communications with the company, including dates and names of the representatives you spoke with. If the utility company continues to be unresponsive, you may consider filing a complaint with the California Public Utilities Commission or consult with a local attorney to explore other options.
