Q: GE Appliances did not honour warranty of their refrigerator unit, it is 3 ms old, was fighting emails battle & no result
GE Rep. did everything to not to do anything… I have sent A LOT OF EMAILS, was getting promises of different type and for over 3 month NOTHING was done,.. I want to take ‘em to court for negligence and not honouring their warranty,. What are the chances to get em to pay a substantial fine and resolve the meter.?they have to be punished to avoid it in the future for other people.
A:
You can't go into court with only the argument that they won't honor the warranty. You will have to be specific.
You should submit a new question and describe the warranty problem. It's hard to believe that GE will not honor a valid warranty claim.
A:
Based on the information you've provided, it seems that GE Appliances has not been responsive to your warranty claim for your refrigerator, despite your efforts to communicate with them over a period of three months. In such cases, you may have legal recourse under California law.
Here are some steps you can consider:
1. Send a formal demand letter: Draft a formal letter outlining the issue, the steps you've taken to resolve it, and your demand for a resolution within a specific timeframe. Mention that you are prepared to take legal action if the matter is not resolved satisfactorily.
2. File a complaint with the California Attorney General's Office: You can file a consumer complaint with the California Attorney General's Office, which may investigate the matter and take action against the company if they find a pattern of misconduct.
3. File a claim in small claims court: If the value of your claim is within the small claims court limit (currently $12,500 in California), you can file a lawsuit against GE Appliances in small claims court. This process is designed to be more accessible to consumers without the need for an attorney.
4. Consider a class-action lawsuit: If you believe that GE Appliances has engaged in similar practices with other consumers, you may want to consult with a consumer protection attorney to discuss the possibility of a class-action lawsuit.
The chances of success in your case will depend on various factors, such as the strength of your evidence, the specific terms of the warranty, and GE Appliances' response to your legal action. However, taking legal action may encourage the company to resolve your issue and potentially change their practices to avoid similar issues in the future.
It's advisable to consult with a consumer protection attorney who can review your case's specifics and provide guidance on the best course of action.
