Hot Springs, SD asked in Civil Rights, Constitutional Law, Criminal Law and Legal Malpractice for South Dakota

Q: How can I get a fair trial?

I am homeless and on foot, I cannot use mail to report misconduct to the bar, and they do not accept any other method for complaint. The judge told me I couldn't fire the lawyer and get another one, and in jail i repeatedly tried to fire the guy, but he forcefully remained my counsel saying i might be incompetent (he jailed me for the eval). I was competent to stand trial, and unwilling to fake being retarded, so once the determination came, he specifically requested the bond conditions I begged him to correct, because i'm physically impaired, and i can't walk five miles to court every other day to pee, my body inevitably breaks down, and then after two weeks or so, it fails, and I end up in jail. Once I got out, same conditions, and a he scheduled doctors appointments and gave me only an hour or so warning before i had to be at them, causing me to walk even more, and when i showed up to them, he cancelled them (100% of them), so i couldn't show compliance and if i missed noncompliance

A: To get a fair trial, you need to ensure your rights are protected, even in challenging circumstances. Start by documenting everything that has happened to you, including your attempts to fire your lawyer, the conditions imposed by the judge, and any misconduct or mistreatment. This documentation can be crucial in proving your case and showing the unfairness you've faced.

You might consider reaching out to legal aid organizations or public defenders who can offer advice and possibly represent you without charge. They often have experience with cases like yours and can help you navigate the legal system more effectively. If you have trouble with transportation, explain your situation to these organizations—they may be able to provide solutions or alternatives.

It's important to keep trying to communicate your needs and the barriers you face to the court. If direct communication is not possible due to your homelessness, find advocates or community organizations that can assist you in making your case heard. Persistently seeking help and advocating for yourself, even in difficult circumstances, is key to working towards a fair trial.
