Q: Can a mayor & city council person have their names on trust funds left to a public library?
I’m a newly elected library board of trustee president. Our mayor has physically taken over two CDs & special account created from trust funds left to the library. We are a small city library & use the city’s tax ID #. From what I read in Chapter 182 of the Missouri Revised Statutes, the library board of trustees should have control over those funds & the board treasurer should be on those accounts along with the city treasurer. But we just discovered the mayor & a city councilman are named as trust agents on those funds. No where in the trust documents is the city mentioned. Only the public library. Plus, I don’t understand how if council members can not be board of trustees members, than how can they have control over funds left to the library?
