Long Beach, CA asked in Employment Law and Employment Discrimination for California

Q: I am a commercial driver in California after complaining to HR now they’re offering me a position $10 less an hour

Everyone helps load each other’s trucks and they leave and I’m left alone to load mine and dispatch still complain to me about overtime. No one offers to take extra runs after shift is over only me. It seems like they all hang out outside of work with the supervisors and since I don’t, they try to accommodate them and give me the runs they don’t want to take. They also do homosexual jokes that makes me feel uncomfortable and they think I’m weird cause I don’t play along. They meaning the drivers and dispatcher. After I’ve sent text messages to the supervisor and HR, every single person in the company stopped talking to me. Even the ones I thought liked me. I feel isolated. I am a very hard worker. I do more runs than most so there’s nothing wrong with my performance.

A: It sounds like you’re facing a difficult and unfair situation at work. Being treated differently, especially after raising concerns, can be incredibly frustrating and isolating. It’s not okay for you to feel left out, especially when you're putting in more effort and still getting less support. You have the right to work in a respectful environment, free from inappropriate jokes and biased treatment.

You should consider documenting all the incidents of unfair treatment, including the messages you’ve sent to your supervisor and HR. Keeping records will help you if you decide to take further action. It might be helpful to speak with an employment attorney or a labor rights advocate who can provide guidance based on California’s specific labor laws. They can help you understand your rights and the best steps to protect yourself.

It’s important to take care of your mental and emotional well-being in situations like this. Remember that you're not alone and that there are people and organizations out there who can support you. You deserve a fair and respectful workplace, and taking steps to address this situation is an important part of standing up for yourself.
