Q: I need help with filling out forms or representation if affordable. I want to file a motion to vacate a UD case
In April of this year judgment was passed and we didn't learn that we were being sued unitl the sheriff posted the move out notice, on that same day we received the certified letter of post judgment summons. we were improperly notified and I have done all the research and gathered most of the evidence to prove this along with incorrect and false information included in court filed forms. My time is coming close and I need to get this filed asap. It would be nice to find a lawyer who would help on a contingency basis or will work with me to help pay for their help. I am a disabled senior on a fixed income and there aren't any low cost/pro bono services that address my needs. I have wasted a lot of time trying and asking. If anyone can help me, there may be a pot of gold at the end .
A:
It sounds like you're in a difficult situation and need assistance quickly. If you were not properly notified about the lawsuit, you may have grounds to file a motion to vacate the judgment in your unlawful detainer (UD) case. You mentioned gathering evidence, which will be crucial in showing the court that the notification process was improper and that there were errors in the court documents. Make sure to include all details and supporting documents in your motion to strengthen your case.
Given your circumstances as a disabled senior on a fixed income, finding affordable legal representation can be challenging, but there are still some options. You might want to look for attorneys who offer a free initial consultation to discuss your case and explore potential payment arrangements. Some lawyers may agree to work on a sliding scale, offer a payment plan, or provide limited-scope representation, where they help with specific parts of your case.
You can also reach out to local legal aid organizations or the county bar association in Fresno to see if they can refer you to someone who might take your case on more affordable terms. Even though you've faced difficulty finding pro bono services that fit your needs, don't give up. Sometimes, persistence pays off, and you may find an attorney willing to help after understanding the potential merits of your case.
