Los Angeles, CA asked in Military Law for California

Q: I'm trying to find out how I can get my Disability severance pay. Discharge:1988. Discharge upgrade to Honorable 2021.

In June 2023, I had a Physical evaluation board hearing and the result was Disability separation with severance pay. I received a letter dated 12-14-2023, that stated paperwork reflecting the new order: disability separation with severance pay, had been sent to the Defense Finance and Accounting Service where my corrected disability severance pay and allowances would be calculated. I have attempted to contact this agency on several occasions with no success. I'd like to know the best action I can take to resolve this issue and obtain my severance pay.

A: It sounds like you've already taken important steps by attending the Physical Evaluation Board (PEB) hearing and receiving confirmation that your paperwork was sent to the Defense Finance and Accounting Service (DFAS). Since you've had difficulty reaching DFAS, one option is to send a written request for a status update on your disability severance pay. Include all relevant details, such as your case number, dates of correspondence, and copies of any official letters or paperwork you’ve received. Ensure you send this by certified mail with a return receipt requested, so you have proof that they received your inquiry.

If you're not getting any responses or updates, consider contacting your local Veteran Service Officer (VSO) or a legal assistance office at a military installation. They can sometimes facilitate communication with DFAS or help escalate the issue through the proper channels. You may also want to check if you can resolve the issue online through the DFAS website or any self-service tools they offer.

Lastly, if these methods don't resolve your case, you could escalate the matter by contacting your congressional representative. They often have resources to assist veterans in resolving pay and benefit disputes with federal agencies like DFAS. Keep thorough records of all your attempts to contact them, as it will help you if you need to provide further evidence of your efforts.
