A: It's hard to know your status right now. Meaning that I do not know if you are on probation right now or if you are concerned with a new charge.

If you are on probation, and need to detox, or other kind of help, your lawyer can make a motion to alter or change the details of your probation conditions. Most judges will allow you to get drug or alcohol treatment, if it will help you to complete your probation. That is something your lawyer would have to review and then make a motion to have the treatment made part of your probation. If you have a new charge as well, if you do plead guilty to a new charge, you need to make sure it will NOT have any effect on your probation ( it usually does matter).

I hope this helps.
