New Orleans, LA asked in Products Liability for Florida

Q: Can I sue Coca-

Cola? I purchased a 2 L of coke I drank one cup of it and it tasted kind of off about an hour later my stomach started hurting and I began throwing up. I then had my boyfriend to try the Coke too to see if it was just me and it is absolutely the Coke the date on it is fine, but it smells and taste horrible.. now I’m not sure if I should go to the ER to make sure that I haven’t drank something poisonous. I cannot stop throwing up. Do I have a case?

A: A Florida attorney could advise best, but your question remains open for three weeks. From a textbook perspective, it could be a case in terms of defect, injury, and causation. From a PRACTICAL standpoint, if the bad reaction eventually passed, it does not look like a case that most law firms would be interested in handling. But this is only my individual opinion based on the brief facts of the post. With additional details, and any medical documentation from the ER if you eventually decided to go, other attorneys might see things differently. You could reach out to law firms to try to arrange a free consult. That would be the reliable way to answer your question. I hope you and your boyfriend are okay. Good luck
