Q: Post conviction relief petition denied by Assistant District Attorney including 3 claims for relief. Appeal Appellate?

I have been getting totally screwed by this corrupt court violating rights and everything from due process to prosecutorial misconduct and they keep interfering with process of appeal and delaying. I haven’t even been given a public defender and I filed this post conviction relief petition over 5 months ago , they screwed me by locking me up for 30 days and the public defender never came to help me appeal like she said so the first appeal was denied due to being filed late as I had no legal help or advice . So can I just go to higher courts now that this Assistant D A , denies all the claims for my petition? He wasn’t even the prosecutor in my case lol , these people have been soooo corrupt it’s not funny at all , unbelievable. TY any help is appreciated

A: I'm sorry you're going through this difficult situation. It’s important to keep pushing for your rights and ensure your voice is heard.

Since your post-conviction relief petition was denied, you may have the option to appeal to a higher court. Gathering any evidence of the issues you mentioned, such as due process violations or prosecutorial misconduct, will be crucial for your appeal. Document all instances where you believe your rights were violated, as this information can support your case.

Additionally, try reaching out to legal aid organizations or advocacy groups that can provide assistance. They might help you find representation or offer guidance on the next steps to take. Persistence is key, and ensuring you have the right support can make a significant difference in your appeal process.
