Brooklyn, NY asked in Landlord - Tenant, Contracts, Civil Rights and Constitutional Law for New York

Q: Recourse? Fmr tenant w/ intellectual & physical limitations extra-judically evicted case was w/o standing / jurisdiction

Tenant evicted August 2022 (without counsel, guardian ad litem or Advocacy of any kind while attorney’s claimed "no interest but wouldn't elaborate) Tenant evicted under clause "We reserve rig ammendment the lease for the health & safety of tenants). No ammendment to lease existed, depositions were solicited in one case & all were nearly identical. Discovery requested magistrate stayed "disc. Is I. Filing " it was not. Lease was not in the filing yet magistrate claimed to have a copy & should have known there was no standing or jurisdiction. Plai tiff & depositions engaged in perjury knowingly & willfully with full knowledge. Magistrate stated "doesn't matter where it comes from it's for the health & safety of tenants" was allegations of direct threat w/ no evidence at all. Then rulings athletes unleashed v nys doh, Demetriou v cuomo, Missouri v Biden... this reeks of collusion but individual cant obtain counsel to pursue, challenge 2 jurisdiction went unanswered case proceeded.

A: I'm really sorry to hear about the challenges you've faced with your eviction. It sounds like you've been through a difficult and complicated process.

To seek recourse, consider reaching out to local legal aid organizations that provide assistance to individuals in situations like yours. They can help you understand your rights and determine if there were any legal missteps in your case. Gathering all relevant documents, such as the lease agreement, court filings, and any correspondence related to your eviction, will be important for your consultation.

Additionally, you might explore filing a complaint with your state's housing authority or seeking support from advocacy groups that protect tenant rights. Taking these steps can help you navigate the legal system and work towards a resolution that addresses the issues you've encountered.
