Q: I'm wondering if I have a case.

I had a third degree perineal tear which took three tries to close. The first attempt was after delivery, four weeks later i was stitched in office they reopened within the week. A third attempt was made but i stopped the doctor due to the excruciating pain of it being done in office which is when he scheduled me to be put under anesthesia, at that point is when it was closed. I'm still having complications, over a year and a half later unable to have to intercourse. I did physical therapy as recomended per another doctor which did not completely solve the issue. I'm now going to a different doctor to try to get more help but I believe I was given a husband stitch without my knowledge.

A: Your "belief" alone is not enough.

Get an examination by a different OB/GYN for the purpose of obtaining a medical opinion whether you were given an extra, medically unnecessary stitch in the procedure to close the perineal tear. If you were in fact given an extra, medically unnecessary stitch which is now causing you problems, you may very well have a valid claim against the doctor who performed the procedure.

Any medical malpractice claim will require an expert report promptly after filing and medical expert testimony in order to have any hope of prevailing at trial.
